Welcome to www.craftquila.com (the “Site”), operated by Craftquila Inc., a Florida corporation (“Craftquila,” “we,” “our,” or “us”). By accessing or using this Site, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Site.

1. Eligibility (21+ Only)

This Site is intended only for individuals who are 21 years of age or older.

By using this Site, you confirm that:

• You are at least 21 years old
• You are legally permitted to purchase alcohol in your jurisdiction

We do not knowingly permit use of the Site by anyone under 21.

2. Use of the Site

You agree to use the Site only for lawful purposes and in compliance with all applicable laws and regulations.

You agree not to:

• Attempt to bypass age verification
• Submit false or misleading information
• Engage in fraudulent activity or abuse chargebacks
• Interfere with the Site's operation or security

3. Product Orders & Availability

All orders placed through the Site are subject to acceptance by Craftquila.

We reserve the right to:

• Refuse or cancel any order for any reason
• Limit quantities
• Correct pricing or description errors
• Cancel orders due to compliance, fraud, image violations, or inventory issues

If an order is canceled, any payments collected will be refunded in accordance with our policies.

4. Custom Image Uploads & Content Responsibility

Craftquila allows customers to upload images for custom bottle labels.

By uploading an image, you represent and warrant that:

• You own the rights to the image or have permission to use it
• The image does not infringe intellectual property rights
• The image does not contain illegal, hateful, obscene, or offensive content

Craftquila reserves the right to:

• Review, reject, or cancel any order based on image content
• Refuse to print images at our sole discretion

Craftquila is not responsible for how an uploaded image appears when printed so long as it reasonably reflects the submitted file.

5. Intellectual Property

All content on the Site — including text, images, logos, designs, templates, and branding — is the exclusive property of Craftquila Inc. and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or use any Site content without prior written consent.

6. Pricing & Payments

All prices are displayed in U.S. dollars.

Payments are processed securely through Stripe. Craftquila does not store or process payment card information.

By placing an order, you authorize Stripe to charge your selected payment method.

7. Shipping & Delivery

Shipping terms, delivery timelines, and signature requirements are outlined in our Shipping Information page, which is incorporated into these Terms by reference.

Risk of loss transfers to the customer once delivery is attempted by the carrier.

Craftquila is not responsible for:

• Carrier delays
• Missed deliveries due to unavailable recipients
• Returned packages due to failed delivery attempts

8. Alcohol Responsibility Disclaimer

Craftquila promotes responsible consumption.

• Products are not intended to encourage excessive or unsafe alcohol use
• Craftquila makes no medical or health claims
• We are not responsible for misuse, overconsumption, or actions taken after delivery

Please drink responsibly.

9. Limitation of Liability

To the fullest extent permitted by law, Craftquila shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Personal injury or property damage resulting from product misuse

Craftquila's total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Craftquila Inc., its officers, directors, employees, and partners from any claims, damages, or expenses arising from:

• Your use of the Site
• Your uploaded content
• Your violation of these Terms

11. Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms or the Site shall be resolved through binding arbitration, except that either party may bring claims in Florida state or federal courts where arbitration is not permitted by law.

You agree that:

• Disputes will be resolved on an individual basis
• You waive any right to participate in class actions or class-wide arbitration

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
